This is the StudyLight terms of service. It is the same document shown inside the app under Settings → Terms of Service.
1.1 These Terms of Service ("Terms") are a legally binding agreement between you and Voraky Retail LLP (LLPIN AAP-1854), a limited liability partnership registered in India, trading as Caliberix ("we", "us", "our"). They govern your use of the StudyLight mobile application and its related services ("StudyLight").
1.2 By installing, accessing or using StudyLight, creating an account, or buying a subscription, you accept these Terms and our Privacy Policy. If you do not accept them, do not use StudyLight.
1.3 These Terms are an electronic record under the Information Technology Act, 2000 and require no physical or digital signature.
2.1 You must be at least 18 years old and have reached the age of majority where you live to accept these Terms, create an account or buy a subscription.
2.2 StudyLight is designed to be set up and managed by a parent, guardian or teacher. A child may use it only under the supervision of that adult, who is responsible for the child's use and for any account and subscription.
2.3 If you use StudyLight with a child who is not your own — for example as a teacher — you confirm that you have the authority of the child's parent or lawful guardian to do so.
2.4 StudyLight is offered only in the countries selected on its Google Play listing. It is not offered in the European Economic Area or the United Kingdom. If you use it anywhere else, you do so on your own initiative and are responsible for complying with local law. You confirm that you are not located in, or ordinarily resident in, a country subject to comprehensive sanctions, and are not a person with whom we are prohibited by law from dealing.
3.1 Much of StudyLight works without an account. An account is needed for some features, including restoring a subscription on a new phone and cloud scan history.
3.2 You must give accurate information, keep your sign-in credentials secure, and tell us promptly at support@caliberix.com if you suspect unauthorised use. You are responsible for activity under your account, except to the extent it results from our failure to take reasonable care.
3.3 An account is personal to you and may not be shared, sold or transferred.
4.1 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use StudyLight on Android devices that you own or control, for personal, family or classroom use.
4.2 Any other use — including offering lighting assessments, audits or reports to others for a fee, or using StudyLight or its outputs in a commercial product or service — requires our prior written licence.
4.3 StudyLight is licensed, not sold. We and our licensors keep all rights not expressly granted to you.
5.1 Free and Pro features. StudyLight offers features without charge ("Free") and further features to subscribers ("Pro"). The current content of each is described in the app and on the Google Play listing.
5.2 Free allowances. Free allowances — such as a daily number of scans or any one-time bonus scans — are promotional. They have no monetary value, cannot be transferred or exchanged, and may be changed or withdrawn, with notice in the app where practical.
5.3 Changes. We continually develop StudyLight and may add, change or remove features, content or functionality. If, during a paid subscription term, we materially reduce the Pro features you are paying for, we will tell you in the app, and you may cancel and receive a refund of the unused portion of that term on request.
5.4 Availability. We aim to keep StudyLight available but do not guarantee that it will be uninterrupted, error-free or available on every device. Some features depend on your phone's sensors, camera, operating system, internet connection or Google Play services, and may not work, or work fully, on every device.
5.5 Your data on your phone. Most of your StudyLight data is stored only on your phone and is not backed up by us. It will be lost if you uninstall the app, clear its data, or lose or reset your phone, and cloud scan history is kept only for the period stated in the Privacy Policy. Use the export feature in Settings to keep your own copy.
6.1 Billing through Google Play. Pro is an auto-renewing annual subscription sold and billed through Google Play. Your purchase is also subject to the Google Play Terms of Service and payment terms. Google Play shows the price, the renewal price, any tax, and any introductory offer or free trial that applies to your account before you confirm the purchase. Prices are charged in your local currency.
6.2 Free trials and introductory offers. Eligibility for any free trial or introductory price is decided by Google Play and may depend on your account's history. Unless you cancel at least 24 hours before a free trial ends, it converts automatically into a paid subscription, and you will be charged the price shown at purchase.
6.3 Automatic renewal. Your subscription renews automatically at the end of each term, and Google Play charges the renewal price, unless you cancel at least 24 hours before the renewal date.
6.4 Price changes. We may change the subscription price for future terms. Google Play will notify you before a change applies to you and, where required, will ask for your agreement. If you do not agree, cancel before the change takes effect.
6.5 Cancellation. You can cancel at any time in Google Play → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal; you keep Pro until the end of the term already paid for. Uninstalling StudyLight or deleting your account or data does not cancel a subscription.
6.6 Refunds. Refund requests are handled by Google Play under its refund policy, which you can use through Google Play → Payments & subscriptions → Budget & history. After Google's refund window, refunds are at our discretion, except where these Terms (5.3, 13.4) or the law give you a right to one. Nothing in these Terms affects any statutory right you have as a consumer to cancel or to a refund.
6.7 Restoring Pro. Pro is linked to the Google Play account used to buy it and to your StudyLight account. To restore Pro on a new phone, sign in with the same accounts.
7.1 StudyLight is a study-environment measurement and educational tool. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It measures a room; it does not test, assess or monitor vision or eye health, and it is not a substitute for an eye examination or for advice from a qualified optometrist, ophthalmologist or doctor.
7.2 Consult a qualified professional regardless of what StudyLight shows if a child squints, holds work unusually close, or complains of headaches, blurred vision or eye discomfort. Do not delay or disregard professional advice because of anything in StudyLight.
7.3 The Colour Blind Check is an educational activity. It is not a screening, test or diagnosis of colour-vision deficiency or of any other condition.
8.1 Readings are estimates from consumer phone sensors. They vary between devices and conditions and may differ from those of a dedicated instrument. StudyLight is not a calibrated or certified measuring instrument, and its readings are suitable only for indicative comparison — one space against another, or the same space over time.
8.2 The Study Environment Score, its bands, thresholds and suggestions come from our proprietary methodology. They are not a standard, certification or official rating, and do not guarantee that a space is suitable for any particular child.
8.3 Do not use StudyLight for building, workplace or school lighting compliance, certification, any commercial transaction, or any safety-critical purpose. Make changes to lamps, fittings or wiring safely and, where appropriate, through a qualified electrician.
8.4 The UV index is a third-party forecast of the peak for a cloud-free sky. Actual UV may be lower or higher, and forecasts may be inaccurate or unavailable. Learn content and StudyTools (including the calculator, formulas, converter, periodic table and grades tool) are provided for general education and convenience and may contain errors. Check any result that matters against an authoritative source.
You must not, and must not help or allow anyone else to:
(a) circumvent, disable or interfere with any subscription check, usage limit or free allowance, including by altering your device's date or time, or modifying app data, to obtain more free use;
(b) copy, modify, distribute, sell, rent, lend or sublicense StudyLight, or resell or share access to Pro;
(c) decompile, disassemble or reverse-engineer StudyLight, or attempt to derive its source code, scoring methods or algorithms, except to the extent the law expressly permits despite this restriction;
(d) access or use our servers or APIs other than through the unmodified app, or scrape, overload or disrupt them;
(e) use StudyLight unlawfully, to infringe anyone's rights, or to collect or share personal data about a child without the authority to do so;
(f) remove or alter any proprietary, patent or trade-mark notice.
10.1 Your content. Content you create in StudyLight — such as room names, notes, flashcards and study plans — remains yours. You grant us a limited licence to host, store and process it only as needed to operate the features you use (for example, cloud scan history) and as described in the Privacy Policy.
10.2 Room names and profiles. Use a place, not a person, when naming rooms. Do not enter more personal information about a child than a feature needs.
10.3 Sharing. When you share a score card, report or export, you choose where it goes and are responsible for sharing it lawfully and appropriately, especially where it concerns a child.
10.4 Feedback. If you send us suggestions or feedback, we may use them freely and without obligation to you.
StudyLight relies on third-party services, including Google Play, Google Play services, Firebase and weather-data providers. Your use of those services may be subject to their own terms. We are not responsible for third-party services or their availability, and a failure of a third-party service does not by itself make us liable to you.
12.1 StudyLight — including its software, design, text, graphics, illustrations, animations, scoring methodology and content — is owned by or licensed to us and is protected by copyright, patent, trade-mark and other laws. Aspects of its measurement and scoring technology are the subject of patent applications pending in India.
12.2 Caliberix™ and StudyLight™ are trade marks used by Voraky Retail LLP under licence. You may not use them without our prior written permission, except to refer to StudyLight accurately.
13.1 As is. To the fullest extent permitted by law, StudyLight is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation.
13.2 Excluded losses. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of data, profits, revenue, goodwill or opportunity, arising out of or in connection with StudyLight or these Terms, even if we were told such loss was possible.
13.3 Cap. To the fullest extent permitted by law, our total liability to you for all claims arising out of or in connection with StudyLight or these Terms is limited to the greater of (a) the amount you paid for StudyLight in the twelve months before the event giving rise to the claim, and (b) INR 1,000.
13.4 What we do not exclude. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under consumer-protection law that cannot be waived. Where the law does not allow a disclaimer or limitation in full, it applies to the fullest extent the law allows.
To the extent permitted by law, you will compensate us for reasonable losses, costs and expenses (including reasonable legal fees) arising from a third-party claim caused by your breach of these Terms, your misuse of StudyLight, or your infringement of anyone's rights.
15.1 By you. You may stop using StudyLight at any time by uninstalling it, and delete your data and account in Settings. To stop paying, cancel your subscription as described in 6.5.
15.2 By us. We may suspend or terminate your access, or your account, if you materially breach these Terms, if we must do so to comply with the law, or to protect StudyLight, our users or others from harm. Where reasonable, we will tell you first and give you an opportunity to remedy the breach.
15.3 Discontinuation. We may discontinue StudyLight or any part of it. If we discontinue Pro during a paid term, we will refund the unused portion of that term on request.
15.4 Effect. On termination, your licence ends. Sections 4.3, 7, 8, 10.4, 12, 13, 14, 16 and 17, and any accrued rights, survive.
16.1 These Terms, and any dispute arising out of or in connection with them or StudyLight, are governed by the laws of India.
16.2 Before starting any legal proceedings, please contact our Grievance Officer and give us 30 days to try to resolve the matter. This does not prevent either party from seeking urgent interim relief.
16.3 Subject to 16.4, the courts at Brahmapur (Berhampur), District Ganjam, Odisha, India have exclusive jurisdiction.
16.4 Nothing in this section limits any right you have under consumer-protection law to bring a complaint before a consumer commission or court where you live, or any mandatory consumer protection under the law of your country of residence.
17.1 Changes to these Terms. We may update these Terms. The updated version will appear in the app and at caliberix.com/terms with a new effective date before it takes effect. We will tell you in the app before any material change takes effect. A material change that is adverse to paying subscribers takes effect from your next renewal. If you continue to use StudyLight after a change takes effect, you accept the updated Terms; if you do not accept them, stop using StudyLight and cancel any subscription.
17.2 Assignment. We may assign or transfer our rights and obligations under these Terms, in whole or in part, to an affiliate, or in connection with a merger, reorganisation or sale of all or part of our business or assets, provided your rights under these Terms are not reduced. You may not assign or transfer your rights or obligations.
17.3 Force majeure. We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil disturbance, government action, and failures of power, networks or third-party services.
17.4 Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions remain in effect.
17.5 No waiver. Our failure or delay in enforcing a provision is not a waiver of it.
17.6 Entire agreement. These Terms, the Privacy Policy and the About & legal notices screen form the entire agreement between you and us about StudyLight. If they conflict, these Terms prevail, except that the Privacy Policy prevails on matters of personal data.
17.7 Notices. We may give you notices in the app, or by e-mail if you have an account. You may give notices to support@caliberix.com.
17.8 Language. If these Terms are translated, the English version prevails.
